Cancellation of an MSIC
There are some instances where an issuing body may cancel an MSIC, including:
- the issuing body determines the MSIC was not issued in accordance with its MSIC plan or the regulations
- AusCheck informs the issuing body that a security assessment of the person was adverse
- the issuing body becomes aware that the holder does not have a right to work in Australia
- the holder has been convicted of a disqualifying offence
- the holder no longer has an operational need for an MSIC
- the holder of a four year MSIC withdraws consent for the mid-term check and returns the MSIC prior to the check being completed.
Note: If a person had their MSIC cancelled at their own request (voluntary surrender) or returned because of no operational need, they may, within a 12 month period from the date of cancellation, re-apply for their MSIC to be re-issued provided they have an operational need for an MSIC. This application will be in the normal manner, however, the person must provide a statutory declaration stating that, since the cancellation, no relevant circumstances have changed.
If the application is approved, the expiry date of the replacement MSIC will not be later than the original MSIC.
